Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Callibre AI platform, website, and related services (collectively, the "Service") operated by Callibre AI ("Callibre," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your organization. By creating an account, you represent that you meet these requirements.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account and keep it up to date.

3. Service Description

Callibre AI provides reporting, monitoring, and client retention tools for HighLevel agencies deploying Voice AI and Conversation AI for their clients. The Service includes white-labeled client portals, automated ROI reports, production monitoring, alerting, and portfolio-level reporting capabilities.

The Service integrates with third-party platforms, including HighLevel. Your use of these integrations is also subject to the respective third-party terms of service. We are not responsible for the availability, accuracy, or policies of third-party services.

7. Intellectual Property

The Service, including its design, code, and documentation, is owned by Callibre AI and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service during your subscription term.

You retain ownership of all data you sync to or generate through the Service, including HighLevel call and chat transcripts, client-portal configurations, and reports.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your information as described therein.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of scheduled maintenance.

10. Limitation of Liability

To the maximum extent permitted by law, Callibre AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that reports, alerts, or analytics produced by the Service are exhaustive, or that the Service will detect every possible issue in the HighLevel Voice AI or Conversation AI agents it monitors.

We may update these Terms from time to time. Material changes will be communicated via email or through the Service at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any dispute arising from these Terms shall be submitted to the exclusive jurisdiction of the courts of the Province of Quebec, District of Montreal.

16. Consumer Protection

Nothing in these Terms shall limit or exclude any rights you may have under the Quebec Consumer Protection Act (Loi sur la protection du consommateur) or other applicable consumer protection legislation that cannot be waived or limited by contract.
